Terms of Service

Effective: December 24, 2025

1. Acceptance

By accessing or using TWZRD (the "Protocol" or "Service"), including the portal at collect.twzrd.xyz, you agree to these Terms. If you do not agree, do not use the Service.

2. Protocol Description

TWZRD is an open-source attention oracle on Solana (program ID GnGzNdsQMxMpJfMeqnkGPsvHm8kwaDidiKjNU2dCVZop) that distributes Token-2022 rewards as loyalty incentives for authentic cross-platform engagement. The portal enables identity linking and Merkle proof-based claims.

3. Eligibility & Compliance

• Age: You must be at least 18 years old.
• Sanctions: You warrant that you are not located in, organized in, or a resident of any country or territory subject to comprehensive U.S. sanctions (see OFAC Sanctions Programs).
• VPN Use: You agree not to use VPNs, proxy servers, or other tools to circumvent geographic restrictions or conceal your location/identity for the purpose of evading these Terms.
• Responsibility: You are solely responsible for compliance with all laws in your jurisdiction, including tax obligations and cryptocurrency regulations.

4. Third-Party Services & Content

• The Service integrates YouTube and Twitch APIs. Your use constitutes agreement to their respective Terms of Service.
• Google Data: TWZRD complies with the Google API Services User Data Policy.
• Content Liability: Embedded streams are third-party content. TWZRD assumes no liability for the content displayed.
• Creator Rights: Creators may request channel removal from the portal interface via privacy@twzrd.xyz. Note: This removes frontend visibility but cannot alter immutable on-chain history.

5. Protocol Integrity & Anti-Gaming

• You must not manipulate the oracle via bots, scripts, multiple identities, or any means to inflate engagement signals ("Sybil attack").
• TWZRD reserves the right to analyze patterns, flag activity, and disqualify violators from rewards (current/future, retroactively) at sole discretion, without notice.

6. Reward Distribution

• Rewards are loyalty incentives for genuine engagement only.
• They are not securities, investments, financial instruments, or guaranteed value.
• Distribution amounts, epochs, and parameters may change or end without notice.
• Scoring aggregates off-chain engagement signals, hashes into Merkle trees; only roots/proofs published on-chain.

7. User Responsibilities & Risks

• Wallet Security: You are responsible for your private keys. We cannot recover funds if you lose access.
• Network Fees: You are responsible for all Solana network fees (rent, gas) associated with claiming rewards.
• Transaction Finality: On-chain transactions are irreversible. Verify all data before signing.
• Claim Windows: If the protocol utilizes epoch-based expiration, rewards not claimed within the designated window may be forfeited.

8. No Warranties & "As-Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee protocol uptime, reward accuracy, or immunity from blockchain-specific risks (e.g., congestion, smart contract bugs, 51% attacks).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWZRD, ITS DEVELOPERS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR FUNDS RESULTING FROM YOUR USE OF THE SERVICE OR PROTOCOL BUGS.

10. Open Source & Licensing

The protocol code is public under MIT/Apache 2.0 licenses and verifiable at github.com/twzrd-sol/attention-oracle-program. Forks or modified versions of this code are independent and not governed by these Terms.

11. Modifications

We may update these Terms at any time. Your continued use of the Service after changes constitutes acceptance.
